My baby has Erb’s Palsy or Brachial Palsy, do I have a case?

Erb’s palsy is a form of brachial plexus palsy. The brachial plexus is a network of nerves near the neck that gives rise to all the nerves of the arm. These nerves provide movement and feeling to the arm, hand and fingers. Erb’s palsy may manifest in varying degrees of weakness or paralysis of the shoulder, arm, or hand. A baby with this injury typically holds a limp arm down by the baby’s side, with the forearm turned inward and with wrist bent. The baby will not be able to lift the arm up. A baby with a very bad injury may also have a droopy eyelid on the side that was injured, along with an injury to the arm and hand.

When the brachial plexus is damaged, the baby may need surgery, therapy, and may never recover proper feeling or movement in the affected arm. This injury can be caused by medical error, such as excessive strain during delivery or mismanagement of the birth. Often times, Erb’s palsy occurs because too much force is placed on the baby’s head while the baby’s shoulders are still in the birth canal. Erb’s palsy is preventable most of the time. The way to prevent Erb’s palsy is through good monitoring during pregnancy, to insure that the baby is not too large for the mother to birth. Also, proper assessment of whether a C-section is preferable can prevent Erb’s palsy.
